Master Liability Waiver & Assumption of Risk Terms

(Applies to All Guests, Retreat Participants, Signature Solo Guests, Retreat Leaders, Visitors, and Vendors)

At Hidden Leaf Baja (“HLB”), we are committed to providing a beautiful, restorative, and safe retreat experience for all of our guests. This Master Liability Waiver (“Waiver”) explains the responsibilities, risks, and expectations associated with all stays, retreats, programs, activities, and services offered on the property.

This Waiver applies to:

• Vacation rental guests
• Retreat leaders and facilitators
• Retreat participants
• Signature Solo participants
• Event guests and vendors
• Visitors and day guests
• Anyone engaging in activities, sessions, or services on the property

By entering the property, participating in a retreat, booking a Signature Solo, using HLB’s facilities, or engaging with independent practitioners or vendors, you agree to this Master Liability Waiver.

 

General Release of Liability

You acknowledge that your stay or participation at HLB is voluntary, and you assume full responsibility for any risks or injuries that may occur.

To the fullest extent permitted by law, you release, waive, and discharge Hidden Leaf Baja, its owners, employees, managers, agents, practitioners, service providers, and independent contractors (“Released Parties”) from any liability for:

• Personal injury or death

• Illness (including allergic reactions, heat-related events, dehydration, or conditions impacted by wellness activities)

• Property damage or loss

• Accidents or slips and falls

• Emotional or psychological effects of wellness sessions

• Damages arising from use of the property, facilities, or amenities

• Acts or omissions of third-party vendors or practitioners

This waiver applies whether the injury or harm occurs in your casita, the domes, common areas, the pool, hot tub, outdoor spaces, walkways, parking areas, or off-site during retreat programming.

Assumption of Risk

You understand and acknowledge that the property includes natural terrain, uneven surfaces, sand paths, steps, gravel walkways, open-air areas, wildlife, and outdoor environments that may pose inherent risks.

You voluntarily assume all risks associated with:

Property-Related Risks

• Uneven ground, rocks, steps, and natural terrain
• Slippery surfaces, especially after rain or pool use
• Sand and gravel pathways
• Limited outdoor lighting in some areas
• Presence of insects or wildlife common to Baja Sur

Amenity Risks

• Pool and swimming activities
• Hot tub use
• Outdoor showers
• Lounge areas, hammocks, and decks
• Use of fans, heaters, AC units, and electrical equipment

Weather & Environmental Risks

• Heat, sun exposure, dehydration
• High winds, storms, or weather changes
• Dust, pollen, or environmental allergens

You agree that HLB is not responsible for these naturally occurring risks.

 

Retreat & Wellness Activity Risks

If you participate in a retreat, Signature Solo, private session, or wellness activity, you acknowledge that such activities carry additional risks, including but not limited to:

• Yoga, stretching, and movement practices

• Somatic work, breathwork, meditation, emotional release, or trauma-informed practices

• Water-based therapy or aquatic movement

• Bodywork, massage, acupuncture, or energy work

• Cacao ceremonies, sound healing, or guided experiences

• Nature walks, beach excursions, or off-site programs

• Physical exertion or increased heart rate

You voluntarily assume all risks associated with these activities and agree that: Independent practitioners are not employees or agents of HLB.

HLB is not liable for any injury or dissatisfaction arising from their services.

 

Medical Responsibility & Health Disclosure

You confirm and agree that:

• You are physically and mentally capable of participating in all chosen activities.

• You will disclose any relevant medical or psychological conditions prior to participation.

• You will stop any activity immediately if you feel discomfort, dizziness, pain, or instability.

• You are solely responsible for consulting a qualified medical professional before participating in any activity that may impact your health.

HLB does not provide medical services and does not diagnose, treat, or prevent medical conditions.

In the event of an emergency, you authorize HLB to obtain medical assistance for you and agree to be fully responsible for all related costs.

 

Hot Tub + Pool Release

Hot Tub Disclaimer

1. Hot Tub Use: Guests acknowledge that use of the hot tub is at their own risk. Hidden Leaf Baja, its owners, and staff shall not be held liable for any accidents, injuries, health issues, or fatalities that may occur during or after using the hot tub.
2. Health Precautions:

• Individuals with heart conditions, high or low blood pressure, or other medical concerns should consult a physician before using the hot tub.
• Pregnant women are advised not to use the hot tub.
• Children under the age of 12 must not use the hot tub. Children aged 12 to 16 must be supervised by an adult at all times.
• Do not use the hot tub if under the influence of alcohol, drugs, or medications that may impair judgment or physical coordination.

3. Safety Rules:

• Limit hot tub sessions to 15 minutes to avoid overheating. Extended exposure may lead to nausea, dizziness, or fainting.
• Enter and exit the hot tub slowly to prevent slipping.
• No glass containers are allowed in or near the hot tub.
• Do not submerge your head underwater or engage in rough play.

Pool Disclaimer

1. Pool Use: Guests acknowledge that use of the swimming pool and surrounding area is at their own risk. Hidden Leaf Baja, its owners, and staff are not liable for any accidents, injuries, or fatalities that may occur as a result of using the pool.
2. Safety Rules: All guests must adhere to the following pool safety guidelines:

• No diving is permitted in the pool.
• Children under the age of 16 must always be supervised by an adult.
• No running, roughhousing, or unsafe behavior is allowed around the pool area.
• Glass containers are strictly prohibited near the pool.

3. Health and Condition: Guests affirm that they are in good health and physically able to use the pool. Anyone with a medical condition that may be affected by pool use should consult a doctor before participating.

Inherent Risks

You understand the inherent risks of pool and hot tub use and accept full responsibility for:

• Slipping or falling

• Overheating or dehydration

• Reactions to temperature or chemicals

• Water inhalation or submersion

• Injury due to misuse or unsafe behavior

Supervise children at all times, and do not bring glass into or near the pool or hot tub. By using these amenities, you release HLB from all liability related to aquatic use, including liability arising from negligence, accidents, injuries, illness, or death.

 

Use of the Property & Personal Belongings

You agree that:

• You are responsible for securing your personal belongings.

• HLB is not liable for theft, loss, or damage to personal items.

• You will lock doors and windows when you’re not on the property.

• You are responsible for any damage caused by you, your guests, or your participants.

HLB may charge for repair, replacement, or excessive cleaning.

 

We do not offer refunds, discounts, or rent reductions for any appliance or amenity malfunction, inclement weather, mechanical issues, or other circumstances beyond our control. This includes—but is not limited to—loss of utilities (water, internet, cable, electricity), malfunctioning electronics, insects or pests, noise from neighbors, weather conditions, décor preferences, or issues not reported during your stay. The incidental presence of bugs that does not make the Property uninhabitable will not qualify for any refund or discount.

 

Independent Practitioners, Chefs & Vendors

You acknowledge that:

• All practitioners, chefs, culinary teams, and wellness providers operate as independent contractors, not employees.

• HLB does not supervise, direct, or control their methods or professional judgment.

• You release HLB from any harm arising from their services, including food-related sensitivities, preparation errors, or practitioner technique.

You must resolve any disputes with independent vendors directly with them.

 

Vendor Liability

When you hire external vendors for an Event at Hidden Leaf Baja, you agree to release Hidden Leaf Baja from any liability for damages, injuries, or disputes arising from the vendors’ services or actions. You are responsible for ensuring that all vendors carry proper licenses and insurance and comply with the terms of their contracts. Hidden Leaf Baja does not take responsibility for any vendor-related issues, including equipment failures, food service problems, or transportation delays.

 

Alcohol, Substance Use & Personal Choices

You are solely responsible for your decisions, behavior, and consumption of alcohol or substances (if permitted by your retreat leader).

HLB is not liable for injuries or harm resulting from intoxication or impaired judgment.

 

Emotional & Mental Health Acknowledgment

Some retreat experiences or sessions may bring up emotions, memories, or psychological responses.

You acknowledge that wellness modalities can produce intense emotional shifts and agree to:

• Participate at your own pace

• Seek professional mental health support independently if needed

• Communicate with facilitators if you feel overwhelmed

HLB is not responsible for emotional distress or psychological outcomes.

Indemnification

You acknowledge that the use of the Property by the Rental Party and Guest’s Visitors is entirely at their own risk. You will indemnify and hold us harmless from any and all expenses, costs, damages, suits, actions, or liabilities whatsoever arising from or related to your actions or negligence, violations of property rules, injury to yourself or others, damage to property or equipment, disputes with vendors, practitioners, or other participants, any and all loss of or damage to severe weather, acts of terrorism, personal property, injury or death resulting from the use or occupancy of the Property (including reasonable attorney’s fees) or the failure of any member of Rental Party or Guest’s Visitors to observe these Terms.

Limitation on Liability

Hidden Leaf is not responsible for any accidents, injuries or illness that occur to any member of the Rental Party or Guest’s visitors while in the Property or on the Property. We are not responsible for loss of personal belongings or valuables belonging to any member of the Rental Party or any of Guest’s visitors. You agree to assume the risk of any harm arising from use of the Property. UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, TORT, CONTRACT, STRICT LIABILITY, OR OTHERWISE, SHALL WE BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY DAMAGES OF ANY NATURE WHATSOEVER INCLUDING ARISING OUT OF OR RELATING TO THESE TERMS OR GUEST’S RENTAL OF THE PROPERTY OR USE OF THE PROPERTY. IN NO EVENT WILL WE BE LIABLE FOR ANY DAMAGES IN CONNECTION WITH THESE TERMS, EVEN IF WE SHALL HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

All Guests must refrain from any illegal act or any conduct unbecoming, conduct or language which may give offense to a Rental Party guest, or Visitor or any act which may cause damage to the Property.  If Hidden Leaf or any of its staff, consultants or agents become aware of any such act / conduct then Hidden Leaf & its agents may, at their absolute discretion, ask you to leave the premises, property or facility, this will be without refund or compensation to you, in these circumstances Hidden Leaf will have no further responsibility or liability to you or the Rental Party guest.

 

Photo / Video Release

Unless you opt out in writing, you grant HLB permission to use any photographs or videos captured during your stay or retreat for promotional purposes. We will never sell your images to third parties unless you give us permission.

 

Governing Law

The laws of Baja California Sur, Mexico govern this Master Liability Waiver, without using conflict-of-law rules. You agree to resolve any disputes exclusively in the courts of Baja California Sur.

Acknowledgment & Acceptance

By booking, entering the property, participating in a retreat, signing up for a Signature Solo, or engaging in any activities at HLB, you acknowledge and agree that:

• You have read and understood this Master Liability Waiver

• You accept all risks described

• You voluntarily release HLB from liability

• This Master Liability Waiver is binding upon you and your guests

You understand that this Master Liability Waiver supersedes all prior or conflicting liability language in any other HLB agreements.
