RENTAL TERMS AND CONDITIONS

These terms and conditions “Terms” are made by and between Hidden Leaf Baja “Hidden Leaf”, “we”, “us”, or “our” and as identified on the booking reservation “Guest” or “you”. Hidden Leaf and Guest may be referred to individually as “Party” and collectively as “Parties.” For good and valuable consideration, the sufficiency of which is acknowledged, the Parties agree as follows:

 

Rental Period

The Property will be ready for occupancy at 3PM on the date of “Check-In” and must be vacated by 10AM on the date of “Check-Out”, unless otherwise agreed by us. If Guest or any member of the Rental Party remains on the Property beyond the Check-Out time, you will be responsible to pay an additional full night rate. A 3-night minimum stay is required for all reservations.

For long-term stays (rental periods exceeding 8 nights), guests are responsible for refilling water and propane as needed. You can conveniently purchase replenishments through our Host Co store here. We also reserve the right to charge for electricity usage during your stay.

 

Reservation Deposit and Final Payment

A “Reservation Deposit” is required to book the Property. You agree to pay the rental rate and fees, collectively referred to as the “Total Amount Due.” When booking directly with Hidden Leaf, the Reservation Deposit is refundable if canceled 30 days or more before the Check-In date, unless the booking is made through another platform (such as AirBnB or VRBO), where platform-specific policies may apply.  The Reservation Deposit will be applied toward the rental rate. Full payment of all fees, less the Reservation Deposit before Check-In. Reservations made within 60 days of Check-In must be paid in full at the time of booking.

 

Damage Protection

A “Damage Protection” charge is required and will be reflected in your reservation for damages to the Property or furnishings, excessive mess requiring additional cleaning or other costs incurred outside the normal course.

 

Property

The “Property” is owned by Hidden Leaf and is fully furnished and equipped with supplies for light housekeeping, starter supply of toiletries and amenities (such as toilet paper, dishwasher detergent, and dish-washing liquid, etc.), we have no obligation to replenish those items. Additional supplies are Guest’s responsibility.

 

Hot Tub Disclaimer

  1. Hot Tub Use: Guests acknowledge that use of the hot tub is at their own risk. Hidden Leaf Baja, its owners, and staff shall not be held liable for any accidents, injuries, health issues, or fatalities that may occur during or after using the hot tub.
  2. Health Precautions:
  • Individuals with heart conditions, high or low blood pressure, or other medical concerns should consult a physician before using the hot tub.
  • Pregnant women are advised not to use the hot tub.
  • Children under the age of 12 must not use the hot tub. Children aged 12 to 16 must be supervised by an adult at all times.
  • Do not use the hot tub if under the influence of alcohol, drugs, or medications that may impair judgment or physical coordination.
  1. Safety Rules:
  • Limit hot tub sessions to 15 minutes to avoid overheating. Extended exposure may lead to nausea, dizziness, or fainting.
  • Enter and exit the hot tub slowly to prevent slipping.
  • No glass containers are allowed in or near the hot tub.
  • Do not submerge your head underwater or engage in rough play.

 

Pool Disclaimer

  1. Pool Use: Guests acknowledge that use of the swimming pool and surrounding area is at their own risk. Hidden Leaf Baja, its owners, and staff are not liable for any accidents, injuries, or fatalities that may occur as a result of using the pool.
  2. Safety Rules: All guests must adhere to the following pool safety guidelines:
  • No diving is permitted in the pool.
  • Children under the age of 16 must always be supervised by an adult.
  • No running, roughhousing, or unsafe behavior is allowed around the pool area.
  • Glass containers are strictly prohibited near the pool.
  1. Health and Condition: Guests affirm that they are in good health and physically able to use the pool. Anyone with a medical condition that may be affected by pool use should consult a doctor before participating.

Your use of the Hot Tub and Pool releases Hidden Leaf Baja from all liability related to pool use. This waiver includes, but is not limited to, liability arising from negligence, accidents, injuries, illness, or death.

 

Excessive Use

The Property Rental provides you with enough water and gas for the duration of the rental period. Should any gas or water be used in excess, and need to be replenished, you will be charged the appropriate fee to replenish.

 

Events, Production & Photoshoots

Events are not permitted at the Property, without the express written permission of Hidden Leaf. Rental of the Property does not include the use of the Property for an Event. “Event” is the hiring of musical entertainment, professional catering, photographers, production crew, models, rentals of music or entertainment or lighting equipment, among other event services, and the entertaining of more than 5 Visitors at the Property. No music / entertainment equipment must be installed or brought to the Property during the Rental Period. Guest agrees to use the provided speakers on the Property. Should you hold an Event on the Property, without the express written permission of Hidden Leaf, you will be charged a non-refundable penalty of $3,000 USD, in addition to forfeiture of the Security Deposit.

In the event Hidden Leaf provides its express written permission for you to host an Event, you will be bound by the additional terms outlined in the Event Rental Terms and responsible to pay the applicable event fee. Retreats

In the event you are hosting a retreat, you will be bound by the additional terms outlined in the Retreat Rental Terms.

 

Additional Purchases & Convenience Services

For your convenience, we offer a variety of optional services and add-ons, including early check-in/late check-out, firewood, pre-stocked fridge, massage services, and more. These can be purchased through our Host Co store here.

 

Rental Party  

The minimum age for Guest is 25. Family members, guests, and visitors collectively, with “Rental Party” under the minimum age must be accompanied by a parent or legal guardian. As the renter, you agree to be an occupant of the Property for the entire duration of the rental. You agree to be solely responsible for the actions of the “Rental Party” present at the Property at any time during the rental period, and to ensure that all occupants understand and comply with the Terms. All persons in the Rental Party will be bound by these Terms.

 

Maximum Rental Occupancy

The maximum number of persons allowed to stay in the Property is limited to 16, unless we give prior written consent. The number of Visitors present at the Property may not exceed the maximum posted occupancy unless we have given you advance written permission to hold an Event at the Property, in which case the number of Visitors present at the Property may not exceed the maximum number authorized by Us.

 

Visitors

Visitor” is an invitee who is not staying overnight at the Property. The total number of visitors permitted at the Property at any given time, is 5, unless we give our prior written consent.

 

Keys & Access Codes

We will provide you with access codes to the Property prior to Check-In.

We may provide you with keys or gate remote for entry to the Property. You are not allowed to make duplicate keys. A fee of $150 USD will be charged to you for failure to return any keys or remote. Any attempt to access a locked area is just cause for immediate termination of these Terms, forfeiture of all rent paid, and you will be liable for any missing items or damage.  In the event you are locked out during their stay, and we must come to the Property and there will be a (a) $20.00 USD cash fee during business hours; (b) $50.00 USD fee after-hours which must be paid directly to the agent in cash prior to your receipt of the key.

 

Rental Rules

Guest agrees to abide by the Rental Rules more fully described below and any other restrictions imposed by Hidden Leaf. At all times while on the Property, you will and will cause all persons in the Rental Party and any Visitors that you permit on the Property to abide by the Rental Rules while on the Property.

If any person in the Rental Party fails to follow any of the Rental Party Rules, the Rental Party may be asked to vacate the Property immediately, and you will forfeit all the rental amount.

 

Guest Insurance Requirement

Guests booking a vacation rental at Hidden Leaf Baja are required to carry travel insurance to cover trip cancellations, personal belongings, and any unforeseen circumstances during their stay.

For event or retreat rentals, hosts must obtain appropriate liability insurance, such as event insurance or renter’s insurance, to cover potential property damage and participant injuries. Proof of insurance may be requested at the time of booking.

Hidden Leaf Baja is not liable for any loss, damage, or injury not covered by the guest’s or host’s insurance policy. Any coverage limitations or exclusions are the responsibility of the insured party. For insurance referrals, please visit our Rental Insurance page.

Insurance options:

 

Cancellation

We encourage all guests to purchase travel insurance to help protect against financial loss if Guest must cancel their reservation for a covered reason. We are a small business and have very strict cancellation policies. Guest may cancel the reservation at least (30 days for the Casita and 60 days for the whole estate) before Check-In and receive a refund of the Reservation Deposit.  If canceled before the cancellation period, the Reservation Deposit is refundable. If canceled after the cancellation period, the deposit will be credited toward a future stay within 12 months.

 

Cleaning

A cleaning fee will be charged to the Guest. Daily cleaning services are included in the rental rate during the rental period. However, the Guest is responsible for maintaining the Property in a clean and good condition. Any unsafe or dangerous conditions must be reported to us immediately, accompanied by photos.

Upon Check-In, you acknowledge that the Property is in good condition, except for any defects you report to us by the end of the first day following Check-In, via text or email, with accompanying photos. The Property should be left in the same condition in which it was found upon Check-In. You agree to leave the Property in good repair.

For rental periods exceeding 7 nights, cleaning services will be scheduled as follows:

  • For stays of 8 to 21 nights, cleaning will be provided every other day.
  • For stays of 22 nights or more, cleaning will occur weekly, except on Sundays and major Mexican holidays.

Please note: Additional cleaning fees may apply for stays over 7 nights.

Cleaning services will not take place on Sundays or major Mexican holidays.

 

Chef Guidelines for Private Dinners

Cleaning and Maintenance:

  • The kitchen and all cooking areas must be left in the same condition as they were found. Chefs are responsible for cleaning all surfaces, utensils, and equipment used during meal preparation.
  • No food waste or grease should be disposed of in the garbage disposal. Use designated waste bins for disposal of food scraps and oils to prevent clogging and damage to the plumbing.
  • Cutting boards should not be soaked in water or placed in the dishwasher. They must be washed by hand with mild soap and water, then properly dried and stored.

Use of Equipment and Appliances:

  • Hidden Leaf Baja’s appliances, cookware, and utensils are strictly prohibited from use by chefs or their staff. Chefs must bring their own equipment and tools for cooking and serving.
  • Personal cooking or frying equipment (e.g., deep fryers, grills, or any electrical devices not provided by Hidden Leaf Baja) is not allowed in the kitchen. This is to ensure safety and prevent overloading electrical circuits or causing damage to kitchen facilities.
  • Any damage to the kitchen, appliances, or equipment will be the responsibility of the chef or catering team, and costs for repair or replacement may be deducted from the security deposit or billed directly.

Storage and Organization:

  • Use only the designated prep areas for cooking and storing ingredients. The pantry, refrigerator, and freezer spaces reserved for the Property’s use should not be accessed or tampered with.
  • All leftover food or ingredients must be properly labeled, stored, or discarded at the conclusion of the event. Any items left in the kitchen after the event may be disposed of by Hidden Leaf Baja staff.

Hygiene and Safety:

  • Chefs must ensure proper ventilation when using the stove, oven, or any cooking equipment that produces smoke or strong odors. Use the kitchen’s exhaust fans as needed to prevent buildup.
  • Fire safety is paramount. Chefs must ensure that no open flames are left unattended and should be aware of the locations of fire extinguishers and safety protocols in case of emergency.

 

Furnishings and Damage to Property

All contents of the Property are the property of Hidden Leaf. Furniture, bedding, kitchen equipment, utensils, and any other personal property supplied with the Property must not be removed from the Property. Rental Party is not permitted to alter the wiring of any television, computer, or gaming equipment or electrical devices, lighting, etc.  Loss of any items within the Property or damage to the Property or furnishings more than normal wear and tear will be charged to Guest.

 

The Property will be inspected by us after your departure. If an item should break, you must notify us immediately by text or email with accompanying photos. We reserve the right to charge the customer for any damages or excessive cleaning required as a result of your or Rental Party’s behavior.  An Excessive Cleaning Fee of $350 USD will be applied for, but not limited to, issues such as, stains from blood, alcohol, food, candy, liquid, makeup, food and beverage and/or other permanent products; broken, burnt or torn furniture; missing furniture; broken, burnt or damaged tiles, glass, art, included décor, wall paint or wood; damage by an installation (including but not limited to; wax from candles, floral display stains, damage from equipment movement or use), theft or damage from guests failing to properly lock the front gate and/or their rooms, removal of covers from the furniture, disposing of all ashes, rubbish, garbage, and other waste NOT in the provided trash receptacles, leaving trash on porches, decks, or any other exterior location, leaving glass containers at the exterior areas, destroying, defacing, damaging, or removing any part of the Property or rendering inoperable any smoke detector, causing or permitting any unsafe or unsanitary conditions in the area surrounding the Property, NOT keeping the Property safe and clean. In the case that such damage occurs, you will be charged an Excessive Cleaning Fee of $350 USD and/or a Property Damage Fee of $75 USD penalty plus the cost of whatever materials are required to repair the damage.

Personal Property

To prevent theft of or damage to furnishings or personal property, you agree to close and lock doors and windows when not present at the Property and upon check-out. We will not be liable or held responsible for items left behind following departure, missing, lost or allegedly stolen items during the rental period.

 

Mechanical Failures

Hidden Leaf attempts to properly maintain the Property will make every effort to ensure that your stay during the rental period is safe, comfortable, and enjoyable. While all electrical and mechanical equipment within the Property is in good working order, we cannot guarantee against mechanical failure of electrical service, stopped plumbing, water supply, heating, air-conditioning, audio-visual equipment, internet access, cable service, or appliances. You agree to report any inoperative equipment or other maintenance problem to us immediately by text or email with accompanying photos. We will make every reasonable effort to have repairs done quickly and efficiently, however, cannot guarantee when the problem will be resolved. Speed of service cannot be guaranteed. Guest will allow us, or a designated representative access to the Property for purposes of repair and inspection.

 

We are not responsible for any inconvenience that may occur and no refunds or rent reductions will be made due to failure of such items. Additionally, Guest agrees that NO refunds, discounts, or transfers will be granted for the malfunction of any appliance or amenity, inclement weather, mechanical breakdowns, or other adverse circumstances beyond our control. Further examples of circumstances which DO NOT warrant any refund, discount, or alternate Property, etc. include but are not limited to: breakdown of air conditioners; TV’s, or other electronics or appliances which malfunction, presence of insects; disruption of utility services including cable, internet, water, electric satellite; a Property not decorated / accommodated / improved / updated to Guest’s tastes; problems which have not yet been reported to us; bad weather; or noisy neighbors. The incidental presence of pests or bugs which do not render the Property unfit or uninhabitable will not present cause for refunds, discounts, or transfers.

 

Limitation on Liability

Hidden Leaf is not responsible for any accidents, injuries or illness that occur to any member of the Rental Party or Guest’s visitors while in the Property or on the Property. We are not responsible for loss of personal belongings or valuables belonging to any member of the Rental Party or any of Guest’s visitors. You agree to assume the risk of any harm arising from use of the Property. UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, TORT, CONTRACT, STRICT LIABILITY, OR OTHERWISE, SHALL WE BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY DAMAGES OF ANY NATURE WHATSOEVER INCLUDING ARISING OUT OF OR RELATING TO THESE TERMS OR GUEST’S RENTAL OF THE PROPERTY OR USE OF THE PROPERTY. IN NO EVENT WILL WE BE LIABLE FOR ANY DAMAGES IN CONNECTION WITH THESE TERMS, EVEN IF WE SHALL HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

 

Indemnification

Guest acknowledges that the use of the Property by the Rental Party and Guest’s Visitors is entirely at their own risk. You will indemnify and hold us harmless from any and all expenses, costs, damages, suits, actions, or liabilities whatsoever arising from or related to any and all loss of or damage to severe weather, acts of terrorism, personal property, injury or death resulting from the use or occupancy of the Property or the failure of any member of Rental Party or Guest’s Visitors to observe these Terms.

 

Data Protection/Privacy

Data Protection and Privacy: In compliance with applicable privacy laws, including but not limited to the General Data Protection Regulation (GDPR), Hidden Leaf Baja respects the privacy of all guests and protects their personal data. Any data collected during bookings or rentals, including contact information and payment details, will be stored securely and only used for the purposes of managing the rental or event. We will not share or sell personal information to third parties without explicit consent. Guests have the right to request access to or deletion of their personal data at any time.

 

Acts of God

If there is a storm or severe weather and a mandatory evacuation order is issued by state or local authorities, Guest shall be entitled to a prorated rental credit for each night Guest is unable to occupy the Property. Hidden Leaf shall not be liable, nor shall it be deemed in default under these Terms, for any failure to perform or delay in performing any of its obligations due to or arising out of any act not within its control, including, without limitation, acts of God.

 

Violation of Terms

If you or any member of the Rental Party violates any of these Terms, including but not limited to maximum occupancy, visitors and rental rules and restrictions, Hidden Leaf may terminate any Event underway at the moment of violation, evict Guest and the Rental Party from the Property and Guest will forfeit all rent and security deposit paid. Each person renting or occupying the Property is jointly and severally liable under these Terms, and we may proceed against any one or all of the Rental Party without first proceeding against any other.

 

Interpretation

No provision of these Terms may be interpreted for or against any Party on the basis that it drafted such provision, and no presumption or burden of proof may arise disfavoring or favoring any Party because of the authorship of any of the provisions of these Terms.

 

No Waiver

Neither Hidden Lead nor Guest shall be deemed to have waived any provision of these Terms or the exercise of any rights held under these Terms unless such waiver is made expressly and in writing.

 

Severability

If any provision of these Terms is held to be invalid or unenforceable in whole or in part, the remaining provisions shall not be affected and shall continue to be valid and enforceable as though the invalid or unenforceable parts had not been included in these Terms.

 

Notices

Any notice or communication under these Terms must be in writing and sent via electronic email transmission.

 

Successors and Assigns

These Terms will inure to the benefit of and be binding upon us, our successors, and assigns, and upon Guest and its permitted successors and assigns.

 

Entire Terms

These Terms and the Rental Rules represents the entire understanding and Terms between the Parties with respect to the subject matter of these Terms and supersedes all other negotiations, understandings, and representations (if any) made by and between the Parties.

EVENT RENTAL TERMS

 

The supplemental Event Rental Terms are hereby incorporated by reference and form an integral part of the Terms and are addition to the Terms and shall be subject to the same terms, rights, and obligations. In the event of any conflict between the provisions of these Event Rental Terms and the Terms, the Terms shall prevail unless explicitly stated otherwise herein.

 

Event Rental

Rental of the Property includes the use of the Property for an Event, as expressly permitted by Hidden Leaf and Guests payment of an Event fee. “Event” is the hiring of musical entertainment, professional catering, rentals of music or entertainment equipment, among other event services, and the entertaining of more than 5 Visitors at the Property. The Event must take place during the Guest’s stay and before Check-Out.

 

Event Payment

An Event fee is required to have an Event at the Property. You agree to pay the Event fee prior to Check-In at the Property. If you book for vacation rental on another platform (such as AirBnB or VRBO), and plan to have an Event at Hidden Leaf, we reserve the right to charge the Event Fee and it will be in addition to your reservation fees. The Event fee must be paid in full 30 days before Check-In.

 

Production and/or Photoshoot Crew

The minimum age for all working production crew is 20. Crew under the minimum age must be accompanies by a parent or legal guardian and agreed to in advance in writing by Hidden Leaf. As the renter, you agree to be present on the Property for the entire duration of the Event rental period. You agree to be solely responsible for your actions and the actions of all production, photoshoot crew and any other staff present on the Property “Rental Party”, and to ensure everyone understands and complies with these Terms. All persons in the Rental Party will be bound by these Terms herein.

 

Maximum Event Occupancy

The maximum number of visitors for an event is limited to 50 people, unless Hidden Leaf gives its prior written consent. Should the maximum visitor count exceed 50 people, Guest will be responsible to pay and additional event fee of $1,000 USD to cover the additional services needed to accommodate the total number Event Visitors. A Visitor is an invitee who is not staying overnight of the Property.

 

Property Use for the Event

Any Event with more than 50 Visitors or Production, Photoshoot Crew requires an independent planner or day-of coordinator to ensure Event Terms are met. Hidden Leaf can provide recommendations for Guest to negotiate directly.

 

Any set-up and tear-down for the Event must occur during the Rental Period. Access for Guest, Guest’s vendors and Guest’s guests is only allowed during the Rental Period. Guest is responsible to set-up/tear-down for an Event, Hidden Leaf and Property staff will NOT assist Guest with set-up/tear-down. All Event vendors are required to bring ramboard or other protective floor material when loading equipment inside any interior spaces of the Property.  The Property Manager will be available to answer questions and address Property maintenance issues.  Guest will be responsible will be charged an extra cleaning fee of $450 USD. You promise to leave the Property in good repair.

 

Guest must remove all Event items from the Property after Check-Out; this includes items brought by Guest’s vendors and visitors. If all items are not removed or tear-down is not completed by Check-Out, Guest will be charged an extra cleaning fee of $75 USD for each day these items remain on the Property, an additional nightly rate depending on the extent of the items left behind.

 

Vendor Liability Waiver

In cases where external vendors are hired for Events at Hidden Leaf Baja, the Guest agrees to release Hidden Leaf Baja from any liability for damages, injuries, or disputes arising from the vendors’ services or actions. It is the responsibility of the Guest to ensure that all vendors have the appropriate licenses, insurance, and adhere to the terms of their contracts. Hidden Leaf Baja will not be held accountable for any vendor-related issues, including but not limited to equipment failure, food service, or transportation delays.

 

Noise Levels and Event Curfew

To ensure the comfort of all Guests and maintain good relations with our neighbors, Hidden Leaf Baja enforces strict noise limits for Events. Noise levels must be kept below 60 decibels after 9:00 PM. All outdoor Events must end by 10:00 PM unless prior written approval is obtained from Hidden Leaf Baja. Failure to adhere to these rules may result in immediate termination of the Event and forfeiture of any security deposit.

 

Event Rules for Guest’s + Vendors (Guest is responsible for communication of rules)

  • All Event vendors must provide proof of insurance and adhere to the Event Rental Terms.
  • Guest must provide a list of vendors and vehicle types arriving to the Property. Only smaller vehicles are allowed inside of the Property.
  • Vendors are required to bring RAM board or other protective covering for any interior space load in.
  • Use of all floral arrangements, vases, mason jars, etc., around the Property is ABSOLUTELY PROHIBITED.
  • Painters tape is the preferred method to attach décor items to walls or fixtures in the Property. Tape must be removed completely along with the décor items during tear-down use of thumb tacks, nails or screws in any wall, fixture or equipment is prohibited.
  • The following celebration items are NOT permitted at the Property: bird seed, rice, candles, confetti, confetti cannons, party string, Chinese sky lanterns, balloons, sparklers, strobe lights or fireworks. These items are a danger to the Property, our neighbors, wildlife and other guests. If these items are used, Guest will be charged a fee for each illegal item.
  • The following items may be used OUTDOORS ONLY: bubbles, lavender, real flower petals (or other similar organic materials). If any of these items are used inside the Property, Guest will be charged an extra cleaning fee of $150 USD.
  • Candles are not permitted to be used on the Property (including the pool), without the express written permission of Hidden Leaf. If we provided our express written permission to use candles, they must be contained within a glass or similar vase to prevent wax leakage and damage to the Property. Use of LED candles are encouraged.
  • All music / entertainment equipment must be installed and removed during the rental period.
  • Hidden Leaf reserves the right to end music/entertainment for not following these rules.

  • All leftover food or ingredients must be properly labeled, stored, or discarded at the conclusion of the event. Any items left in the kitchen after the event may be disposed of by Hidden Leaf Baja staff.

 

Hygiene and Safety:

  • Chefs must ensure proper ventilation when using the stove, oven, or any cooking equipment that produces smoke or strong odors. Use the kitchen’s exhaust fans as needed to prevent buildup.
  • Fire safety is paramount. Chefs must ensure that no open flames are left unattended and should be aware of the locations of fire extinguishers and safety protocols in case of emergency.

 

Entire Terms

These Terms and the Rental Rules and the Event Rental Terms represents the entire understanding and terms and conditions between the Parties with respect to the subject matter of these Terms and supersedes all other negotiations, understandings, and representations (if any) made by and between the Parties.
